Everest Development Company Responds to OSHA Report

(Jan 08, 2008)-- Everest Development Company, the developer of The Landmark, released the following statement concerning The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) report about the section of concrete formwork that fell during a construction accident at The Landmark Tower in Greenwood Village, Colorado on July 5, 2007.

The Statement

For Everest Development Company, safety is and has always been the top priority. We are dedicated to following up on every detail as it relates to the event on July 5, 2007. The entire site, including the formwork, was inspected by OSHA 90 days prior to the event. OSHA Inspector Noreen Dougherty was on site for an inspection on Thursday, April 19, 2007 and deemed it a clean site. The event remains under internal investigation and the entire site will continue to be carefully inspected and scrutinized through to construction
completion.

Beck Residential, LLP received three citations for formwork-related items that were related to shoring of the formwork that had been used successfully on 51 of 52 previous concrete pours, which had been previously inspected and passed.

OSHA found no specific cause for the accident and none of the citations issued to the contractor were found to be willful and/or repeat citations and all citations are under review by the contractor, Beck Residential, LLP. A handful of other violations were also cited by OSHA against Beck Residential, LLP, including improper taper of a street lane closure for delivery.

The event on July 5, 2007 took place during the placement and finishing of concrete on the roof of The Landmark Tower. A 30-by-40 foot section of wet concrete fell one story during the concrete pour. Seventeen workers were taken to area hospitals for treatment and were released; all were back at work within four days.

Zack Davidson, president and CEO of Everest Development, has and will continue to encourage buyers to contact city officials and OSHA for additional information. Davidson states, "We were very pleased that all of our buyers understood that while unfortunate, accidents like this can happen on a large construction site where hundreds of construction workers are working every day."
