Banner Health sued over contract breach
www.expertclick.com Banner Health is being sued by a group of physicians for contract breach and for not dealing in good faith.
Saguaro Medical Associates, P.C., a physician group specializing in the management of hospitalized patients with operations in Phoenix and Flagstaff, Arizona, filed the lawsuit Friday, February 8, in Maricopa County Superior Court against Banner Health and Banner Thunderbird Medical Center. The physician group claims that Banner attempted to prematurely end its agreement with Saguaro by making baseless allegations, and despite repeated requests has never provided any specific and substantive information to support its position.
The complaint further alleges that Banner violated the patient assignment process as set forth in the agreement. When requested to do so, Saguaro provided Banner with specific data regarding Banner’s breach. Within days of acknowledging that the Emergency Department was incorrectly assigning patients, Banner countered that Saguaro violated the provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
