Final HIPAA Enforcement Rule

DEPARTMENT OF HEALTH AND HUMAN SERVICES

This update describes the recently published HIPAA Enforcement Rule which establishes procedures for determining HIPAA violations and imposing civil monetary penalties. The rule will go into effect on March 16, 2006 and describes procedural requirements regarding investigations, evidence, hearings and appeals and provides substantive guidance regarding the determination of civil monetary penalties. The Enforcement Rule does not address the imposition of criminal penalties for HIPAA violations, as the criminal provisions are enforced by the U.S. Department of Justice.
