Fairchild Medical Center Agrees to Settle Patient Data Disclosure Lawsuit

Fairchild Medical Center has agreed to settle a class action lawsuit alleging that adding third-party tracking codes on its website disclosed patient information without patients’ knowledge or consent.

HIPAA-covered entity, Fairchild Medical Center, located in Yreka, California, decided to resolve the Delgado v. Siskiyou Hospital, Inc. d/b/a Fairchild Medical Center lawsuit. Allegedly, the medical center used third-party tracking tools like Meta Pixel, on its website, which led to patient data disclosures to third parties without the awareness or permission of patients.

The lawsuit was filed in the Superior Court for Siskiyou County, California. The plaintiffs stated claims including breach of implied contract, negligence, unjust enrichment, invasion of privacy, breach of fiduciary duty, violations of the California Invasion of Privacy Act, the California Constitution, the California Confidentiality of Medical Information Act, Cal. Bus. & Prof. Code, and the Comprehensive Computer Data Access and Fraud Act.

Fairchild Medical Center rejected the allegations and maintained that it did no wrongdoing. The plaintiffs stated that their claims had merit. The parties decided to settle to avoid the costs, delay, and problems related to ongoing litigation.

Settlement Benefits and Class Eligibility

The settlement covers roughly 1,000 California residents whose data was exposed to third parties. Fairchild Medical Center consented to pay attorneys’ fees, settlement management charges, the class representatives’ service awards, and advantages for class members.

Eligible class members may sign up for a one-year membership to CyEx Privacy Shield Pro and may get a one-time cash payment worth $25.00. Excluding oneself from the settlement is no longer possible. The last day to file claims is November 2, 2026. The final approval hearing will be on October 15, 2026.
